Terms of Service
Terms governing your use of Eco-Dry Carpet Cleaning's website and the cleaning services we perform in Maryland.
Last updated
These Terms protect both you and Eco-Dry Carpet Cleaning by setting clear expectations for website use, scheduling, payment, cleaning results, and liability. Please read them carefully before booking service.
Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of the website at https://ecodrymd.com (the "Site") and any inquiry, quote request, scheduling, or service arranged with Eco-Dry Carpet Cleaning ("Company," "we," "us," or "our").
By accessing the Site, submitting a form, requesting a quote, scheduling service, or allowing us to perform work at your property, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site or book service.
If you book on behalf of a business, landlord, property manager, or other entity, you represent that you have authority to bind that entity to these Terms.
Use of the website
You agree to use the Site only for lawful purposes and in a manner that does not:
- Violate any applicable law or regulation
- Interfere with or disrupt the Site, our servers, or networks connected to the Site
- Attempt to gain unauthorized access to any systems, accounts, or data
- Scrape, harvest, or automate access to Site content without our prior written consent
- Misrepresent your identity or affiliation
- Upload malware or harmful code
We may suspend or terminate access to the Site at any time, without notice, for conduct we believe violates these Terms or harms the Company or others.
Information on the Site — no professional advice
Content on the Site — including service descriptions, pricing ranges, blog posts, FAQs, photos, and before-and-after examples — is provided for general information and marketing only. It is not a guarantee of results, a binding quote, or professional advice (legal, insurance, health, or otherwise).
We work to keep information accurate but do not warrant that pricing, availability, service descriptions, or other Site content are complete, current, or error-free. We may change Site content at any time without notice.
Quotes, estimates, and booking
- Non-binding estimates. Quotes or estimates provided online, by phone, text, or email are preliminary unless we expressly confirm a fixed price in writing after an on-site evaluation.
- On-site assessment. Final scope, method, and price may change after we inspect the property, surfaces, soil level, access, and any disclosed or discovered conditions.
- Right to refuse or modify service. We reserve the right to decline service, limit scope, or recommend alternative treatment when conditions are unsafe, outside our capabilities, or likely to cause damage.
- Separate agreements. If we provide a written service agreement, work order, or invoice with additional terms, those documents govern the specific job to the extent they conflict with these Terms.
- No contract until confirmed. Nothing on the Site by itself creates a binding service contract; a job is confirmed only when we accept your booking and you agree to the quoted scope and price.
Scheduling, property access, and your responsibilities
You agree to:
- Provide accurate contact information and a service address within our published service area
- Ensure safe, reasonable access to work areas at the scheduled time, including driveways, entry paths, water, and electricity where needed
- Secure pets and inform us of any animals on the property
- Disclose known issues before service, including pet urine or waste, water damage, mold concerns, dye instability, loose carpet, delamination, fragile or antique items, prior cleaning attempts, and manufacturer warnings
- Move or secure small, fragile, or valuable items unless we agreed in advance to handle them
- Be present or designate an authorized adult (18+) who can approve scope changes and payment
We are not responsible for delays or incomplete work caused by lack of access, undisclosed conditions, or failure to prepare the property as described above.
Cancellation, rescheduling, and no-shows
- You may cancel or reschedule by contacting us as far in advance as possible.
- Appointments cancelled or rescheduled with less than 24 hours' notice, or jobs where we arrive and cannot access the property or perform agreed work, may incur a trip or cancellation fee up to the quoted minimum charge or our reasonable out-of-pocket costs.
- Repeated late cancellations or no-shows may result in declined future bookings.
- We may reschedule due to weather, equipment failure, emergencies, or safety concerns and will make reasonable efforts to notify you promptly.
Payment
- Payment is due upon completion of service unless we agree otherwise in writing.
- You authorize us to charge the payment method on file or collect payment at the job site.
- Prices may include applicable taxes where required.
- Disputed charges must be raised within 7 calendar days of service; otherwise the charge is deemed accepted.
- Past-due amounts may accrue reasonable collection costs and interest permitted by Maryland law.
- We may suspend future service for unpaid balances.
Cleaning results and service limitations
Professional cleaning improves appearance and hygiene but does not guarantee the removal of all stains, odors, spots, discoloration, or damage. Results depend on fiber type, age, prior treatments, soil penetration, dye stability, and other factors outside our control.
Without limiting the foregoing:
- Some stains (including rust, bleach, ink, dye transfer, permanent marker, and certain pet damage) may be permanent
- Odors from deep padding, subfloor, or chronic pet urine may persist or return after surface cleaning
- High-traffic wear, matting, and color loss may remain visible after cleaning
- We do not perform repairs, re-stretching, dyeing, or structural restoration unless expressly quoted
- Steam and moisture-based methods involve controlled moisture; drying times vary by fiber, humidity, and ventilation
You acknowledge that cleaning is an attempt to improve condition, not a warranty of like-new results.
Pre-existing conditions, damage, and your property
- Many flooring and fabric problems exist before we arrive — including loose seams, delamination, color bleed, shrinkage, latex breakdown, wood finish wear, and furniture indentations. Cleaning can reveal or accentuate pre-existing conditions.
- You agree to inspect the property with us before and after service when requested and to notify us immediately of any concern while our technician is on site.
- Claims that work caused damage must be reported within 24 hours of service completion with reasonable detail and, where possible, photographs. Failure to timely report may limit or bar related claims.
- Our liability for alleged property damage is limited as set forth in the Limitation of liability section below and is conditioned on your compliance with disclosure and inspection obligations.
- We are not responsible for damage to items left in work areas, improper prior installations, manufacturer defects, or conditions we could not reasonably foresee despite ordinary care.
Satisfaction and re-service
If you are not satisfied with a completed service, contact us within 48 hours so we can inspect and, at our discretion, perform a reasonable re-clean of the affected area. Re-service is our primary remedy for legitimate service-quality concerns.
Re-service does not apply to:
- Issues caused by undisclosed pre-existing damage or soil
- Stains or odors we identified as unlikely to respond before work began
- Areas outside the original agreed scope
- Damage arising after we left the property
Any satisfaction guarantee described in marketing materials is limited by these Terms and applies only to work performed by Eco-Dry Carpet Cleaning, not third parties.
Intellectual property
The Site and all related content — including logos, trademarks, text, graphics, photos, videos, and design — are owned by Eco-Dry Carpet Cleaning or our licensors and protected by applicable intellectual property laws.
You may view and share individual Site pages for personal, non-commercial reference. You may not copy, modify, distribute, sell, or create derivative works from Site content without our prior written permission.
Reviews, photos, and communications
If you submit testimonials, reviews, photos, videos, or other content to us or post about our work, you grant Eco-Dry Carpet Cleaning a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content for marketing and business purposes, unless we agree otherwise in writing.
You represent that you have the right to grant this license and that your content does not violate any third party's rights. We may remove or decline to use submitted content at our discretion.
Third-party links and tools
The Site may link to third-party websites or tools (for example, maps, review platforms, or booking widgets). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.
Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant uninterrupted or error-free Site operation, or specific cleaning outcomes.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Eco-Dry Carpet Cleaning AND ITS OWNER, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF USE, OR PROPERTY DAMAGE CLAIMED AS INDIRECT, ARISING FROM OR RELATED TO THE SITE OR ANY SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
- OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO A SPECIFIC SERVICE OR THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THAT SERVICE OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (including, where applicable, gross negligence or intentional misconduct to the extent not permitted to be limited).
Indemnification
You agree to defend, indemnify, and hold harmless Eco-Dry Carpet Cleaning and its owner, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your breach of these Terms
- Your misuse of the Site
- Inaccurate or incomplete information you provide
- Undisclosed property conditions or failure to prepare the service location
- Your violation of any law or third-party rights
We may assume exclusive defense and control of any matter subject to indemnification; you agree to cooperate with us.
Governing law and disputes
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules.
Any dispute arising from or relating to these Terms, the Site, or our services shall be brought exclusively in the state or federal courts located in Harford County, Maryland, and you consent to personal jurisdiction and venue in those courts.
YOU AND ECO-DRY CARPET CLEANING WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING to the extent such waiver is enforceable.
Before filing suit, the parties agree to attempt in good faith to resolve disputes by contacting rich@ecodrymd.com or (443) 252-0607.
Force majeure
We are not liable for failure or delay in performance caused by events beyond our reasonable control, including severe weather, natural disasters, utility failures, supply shortages, labor disputes, pandemics, government orders, or equipment failure.
General provisions
- Entire agreement. These Terms, together with any written service agreement and our Privacy Policy, constitute the entire agreement regarding the Site and general service relationship.
- Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
- No waiver. Failure to enforce a provision is not a waiver of future enforcement.
- Assignment. You may not assign these Terms without our consent. We may assign our rights and obligations in connection with a business transfer.
- Survival. Sections that by nature should survive (including payment, disclaimers, limitation of liability, indemnification, and disputes) survive termination.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates the latest revision. Material changes may be noted on the Site. Continued use of the Site or booking service after changes become effective constitutes acceptance of the revised Terms.
